Code Of Intellectual Property Act (No. 52 of 1979) - Sect 176

Mode of giving evidence

176.
(1) In any proceeding under this Code before the Registrar or the Court, the evidence shall be given by affidavit in the absence of directions to the contrary. But, in any case in which the Registrar or the Court shall think it right so to do, the Registrar or the Court may take evidence viva voce in lieu of or in addition to evidence by affidavit.
(2) In case any part of the evidence is taken viva voce, the Registrar may exercise the powers conferred on a commission appointed under the provisions of the Commissions of inquiry Act for compelling the attendance of witnesses and the production of documents and for administering oaths to all persons who shall be examined before him.
