Civil Procedure Code (Amendment) Law (No. 20 of 1977) - Sect 49

Replacement of section 362 of the principal enactment

49. Section 362 of the principal enactment is hereby repealed and the following new section substituted therefor:-
362. Every mandate, writ, warrant, precept, or other process issuing from the Supreme Court, or from any High Court or District Court or Magistrate's Court shall have full force and validity in every place throughout Sri Lanka; and every person charged under the foregoing sections with the duty of executing any such process shall be protected thereby from civil liability for loss or damage caused by, or in the course of, or immediately consequential upon, the execution of such process by him, or in the case of the Fiscal by his officers, except when the loss or damage for which the claim is made is attributable to any fraud, gross negligence, or gross irregularity of proceeding, or gross want of ordinary diligence or abuse of authority on the part of the person executing such process:
