| 23. Section 20 of the principal enactment is hereby amended by the substitution, for all the words from "shall be guilty" to the end of that section, of the following words: "shall be guilty of an offence and shall on conviction be liable to a fine not less than one hundred thousand rupees and not more than two hundred and fifty thousand rupees or to imprisonment of either description for a term not less than two years and not exceeding five years or to both such fine and imprisonment, and where any person who is convicted of an offence mentioned in paragraph (a) of this section in respect of the killing or taking of any elephant is found by the court to be in possession of that elephant or its carcase or tusks or tushes, the court may make order directing such elephant, carcase, tusks, or tushes to be delivered to the possession or custody of any officer of Government to be held by that officer for and on behalf of the State.". |
