Marine Pollution Prevention Act (No. 59 of 1981) - Sect 8

Limitation of liability

8.
(1)
(a) The liability in respect of any one incident under section 6 shall be limited to an aggregate amount of seven thousand two hundred and ten rupees (or its equivalent in terms of special drawing rights held in the special drawing rights department of the International Monetary Fund) for each metric tone of the ship's tonnage.
(b) The maximum liability incurred by the owner or operator of a ship or the owner or person in charge of an apparatus or the owner or occupier of an off-shore installation, pipe line, or place on land, as the case may be, under this Part of this Act shall be limited to an aggregate amount of seven hundred and fifty million rupees (or its equivalent in terms of special drawing rights held in the special drawing rights department of the International Monetary Fund).
(2) If any act referred to in section 6 occurs due to the negligence of the owner, or operator of a ship, or the owner or person in charge of an apparatus, or the owner or occupier of an off-shore installation, pipe line or place on land, as the case may be, such person shall not be entitled to avail himself of the limitations provided in subsection (1) of this section.
(3) In this section " ship's tonnage means the gross tonnage of the ship.
