Merchant Shipping Act (No. 52 of 1971) - Sect 120

National colours

120.
(1) The Minister may, by Notification published in the Gazette, declare what shall be the proper national colours for all ships registered under this Act, and for all ships which are not registered but which are owned by the Government or by any local authority or by any body corporate established by or under any law for the time being in force in Ceylon or by a citizen of Ceylon; and different colours may be so declared for different classes of ships.
(2) If any distinctive national colours, other than the Ceylon national colours declared under sub-section (1), are hoisted on board any Ceylon ship, the owner of the ship, unless he proves that they were hoisted without his knowledge or consent, and the master of the ship and any person hoisting such colours shall each be guilty of an offence and on conviction thereof shall be liable to a fine not exceeding five thousand rupees.
(3) Any officer of the Royal Ceylon Navy or any officer of customs, or any Ceylon Consular officer, or a Shipping Officer, may board any ship on which any colours are hoisted contrary to this Act and seize and take away the colours which shall be forfeited to the Government.
