Merchant Shipping Act (No. 52 of 1971) - Sect 302

Admissibility of documents in evidence

302.
(1) Where any document is by this Act declared to be admissible in evidence, such document shall,-
(a) on its production from proper custody, be admissible in evidence in any Court before any person having by law or consent of parties authority to receive evidence; and
(b) subject to all just exceptions, be evidence of the matters stated therein in pursuance of this Act or by any officer in pursuance of his duties as such officer.
(2) A copy of any document referred to in subsection (1), or any extract therefrom, shall also be admissible in evidence- and that officer shall provide such a certified copy or extract to any person applying therefore at a reasonable time, upon payment of the prescribed fee.
(a) if it is proved to be an examined copy or extract; or
(b) if it purports to be signed and certified as a true copy or extract by the officer to whose custody the original document was entrusted,
(3) Any person having by law or consent of parties authority to receive evidence shall have the same powers as a Court to impound any document referred to in this section which has a false or counterfeit seal, stamp or signature affixed thereto.
