Merchant Shipping Act (No. 52 of 1971) - Sect 320

Power to apply Act to ships of other countries, and to exempt such ships

320.
(1) Where the Minister is satisfied that any provisions of the law of any Commonwealth country (other than Ceylon) or of any other foreign country, which apply with respect to ships registered in or belonging to that country while they are at any port in Ceylon are substantially the same as, or equally effective as any of the provisions of this Act or any subsidiary legislation made thereunder, he may by order direct that all or any of such provisions shall not apply with respect to ships registered in or belonging to that country while they are at any port in Ceylon, if it is proved that those ships comply with the corresponding provisions of the law of the country in which they are registered or to which they belong:
(2) Where the Minister is satisfied that the Government of any Commonwealth country (other than Ceylon) or of any other foreign country desires that any of the provisions of this Act or any subsidiary legislation made thereunder which do not apply to ships registered in or belonging to that country, or to any class or description of those ships, should so apply either generally or in specified circumstances, and no special provision for that application is made elsewhere in this Act, he may by order declare that such provisions of this Act or any subsidiary legislation made thereunder shall (subject to any limitation prescribed in such order) apply to ships registered in or belonging to that country or, as the case may be, to any class or description of such ships and to the owners, masters and crews and other persons in the service of such ships when not locally in the jurisdiction of such country, in the same manner as if those ships were Ceylon ships.
(3) Any order made under sub-section (1) or (2) shall, subject to any limitation therein, have effect according to its tenor.
