Merchant Shipping Act (No. 52 of 1971) - Sect 35

Declaration of ownership

35.
(1) A person shall not be registered as the owner of a Ceylon ship or of a share therein until he, or in the case of the Ceylon Shipping Corporation established under Act No. 11 of 1971, or a Government-Sponsored Shipping Company or Corporation or any other body corporate, the person authorized by this Act to make declarations on its behalf, has made and signed a declaration of ownership in the prescribed form referring to the ship as described in the certificate of a Surveyor and containing the following particulars: -
(a) a statement whether he is or is not a citizen of Ceylon, or in the case of the Ceylon Shipping Corporation established under Act No. 11 of 1971, a statement specifying that it was incorporated under that Act, or in the case of a Government-Sponsored Shipping Company or Corporation a statement setting out the interest of the Government and also that it has been incorporated in Ceylon, or in the case of any other body corporate a statement incorporating the Order made by the Minister;
(b) a statement of the time when and the place where the ship was built, or if the ship is built outside Ceylon and the time and place of building is not known a statement to that effect; and in addition in the case of a ship previously registered outside Ceylon a statement of the name by which she was so registered, or in the case of a ship condemned a statement of the time, place and Court at and by which she was condemned;
(c) a statement of the name of the master and his citizenship;
(d) a statement of the number of shares in the ship in respect of which he or the Ceylon Shipping Corporation established under Act No. 11 of 1971, or a Government-Sponsored Shipping Company or Corporation, or any other body corporate, as the case may be, is entitled to be registered as owner; and
(e) a declaration that to the best of his knowledge and belief no unqualified person or body of persons is entitled as owner to any legal or beneficial interest in the ship or any share therein.
(2) For the purpose of this section, the expression " beneficial interest " has the meaning assigned to it by section 106.
