Motor Traffic (Amendment) Act (No. 21 of 1981) - Sect 114

Replacement of section 236 of the principal enactment

114. Section 236 of the principal enactment is hereby repealed and the following section substituted therefor :
236. Where, in any proceedings under this Act, any question arises as to whether or not in respect of a motor vehicle there is a compliance with any provision of this Act or any regulation, or as to whether or not any wheel weigher, weighbridge or other weighing machine for weighing motor vehicles is accurate, the certificate of any examiner, certifying officer, or other prescribed person to the effect that he has examined the vehicle or wheel weighers or weighbridge or other machine for weighing motor vehicles, as the case may be, and stating the result of his examination, shall be admissible in evidence and shall be sufficient prima facie evidence of any fact or opinion stated therein relating to the matter in question, and the court shall not permit the examiner, officer or other person 10 be called for cross-examination on the certificate unless contrary evidence is gives which appears to the court to be credible, or unless for any reason the court considers such cross--examination to be necessary in the Interests of justice.".
