Motor Traffic (Amendment) Act (No. 21 of 1981) - Sect 8

Amendment of section 12 of the principal enactment

8, Section 12 of the principal enactment is hereby amended as follows ;-
(1) by the repeal of subsections (2) and (3) of that section and the substitution therefor of the following subsections :
" (2) On any change of possession of a motor vehicle, other than a motor coach or lorry, upon a voluntary transfer made by the registered owner a
(a) the registered owner shall, within seven days after such change of possession, transmit direct to the Commissioner either by registered post or personal delivery a statement in the prescribed form together with the revenue licence for that motor vehicle and shall deliver to the new owner the certificate of registration relating to the motor vehicle or a duplicate thereof; and
(b) the motor vehicle shall not be used at any time later than thirty days after such change of possession-
(3) On any change of possession of a motor coach or lorry upon a voluntary transfer made by the registered owner
(a) the registered owner shall, within seven days after such change of possession, transmit direct to the Commissioner cither by registered post or personal delivery a statement in the prescribed form together with the revenue licence for that motor coach or lorry and shall deliver to the new owner the certificate of registration relating to that motor coach or lorry or a duplicate thereof;
(b) the motor coach or lorry shall not be used at any time later than thirty days after such change of possession
(2) in subsection (4) of that section
(a) by the substitution for paragraph (a) of that subsection, of the following paragraph :
" (a) the registered owner of the vehicle shall, within seven days after the change o possession, deliver the revenue licence and the certificate of registration relating to the vehicle to the person into whose possession the vehicle has passed, and shall inform the Commissioner in writing of the change of possession ; " ; and
(b) by the substitution for paragraph (e) of that subsection, of the following paragraph ;
" (e) the provisions of subsection (2) (by or subsection (3) (b) shall, where that is a motor vehicle to which subsection (2) applies or is a motor coach or lorry, apply to that motor vehicle in like manner as they would apply, if there was a change of possession of that vehicle consequent upon a voluntary transfer made by its registered owner.".
