40. If in any prosecution for an offence under this Act, there is produced a certificate issued by the Commissioner, a Deputy Commissioner, an Assistant Commissioner, or a police officer of a rank not below that of Assistant Superintendent, to the effect that he is satisfied that the person either against whom the prosecution is instituted, or in respect of whom such offence is alleged to have been committed, is a person-
| (a) who is liable to registration, it shall be presumed, until the contrary is proved by the defence, that such person is a person of the description referred to in that certificate; or |

| (b) who was in any district on a date specified in that certificate, it shall be presumed, until the contrary is proved by the defence, that such person was in that district on that date. |
