The Buddhist and Pali University of Sri lanka (Amendment) Act (No. 37 of 1995) - Sect 15

Amendment of section 16 of the principal enactment

15. Section 16 of the principal enactment is hereby amended as follows:-
(1) by the repeal of subsection (1) of that section and the substitution therefor, of the following subsection:-
"(1) The council of the university (hereinafter referred to as "the council) shall be the executive body and the governing body of the University and shall, subject to the provisions of the paragraph (vii) consist of the following persons:-
(i) the venerable Vice-Chancellor:
(ii) The Dean of each Faculty;
(iii) two members elected by the senate from among its members;
(iv) the Secretary of the Ministry of the Minister in charge of the subject of Buddha Sasana or nominee of such Secretary
(v) the Secretary of the Ministry of the Minister in charge of the subject of Higher Education or the nominee of such Secretary ;and
(vi) such number of members as is equal to the total number of members appointed under paragraphs(i) ,(ii), (iii), (iv), and (v) increased by one. All such members (hereinafter referred to as "appointed members") shall be appointed by the Minister from among persons who have rendered distinguished service in educational, financial, legal and administrative spheres.
(2) by the substitution for the expression "Vice-Chancellor" in subsection (2) of that section, of the expression "Venerable Vice-Chancellor".
(3) by the repeal of subsections (3) and (4) of that section and the substitution therefor, of the following subsection:-
"(3) subject to the provisions of subsection (4). Any appointed member or elected member of the Council shall, unless he vacates office earlier, hold office for a term of three years reckoned from the date of his appointment or election, as the case may be and shall unless removed from office , be eligible for re-appointment or reelection;
(4)
(a) Any appointed member or elected member of the Council may resign his office by writing under his hand addressed to the Minister or to the Venerable Vice-Chancellor of the University, as the case may be.
(b) notwithstanding any thing in this act the appointed members of the Council holding office on the day preceding the date of coming into operation of this section shall, upon the date of coming into operation of this section, cease to hold office as such members;
(5) by the substitution for the expression "President" in subsections (5) and (6) of that section of the expression "Minister"
