Tourist Development (Amendment) Act (No. 2 of 1987) - Sect 2

Insertion of new Part IIA in Act No. 14 of 1968

2. The following new Part is hereby inserted immediately after Part II of the Tourist Development Act, No. 14 of 1968, and shall have effect as Part IIA, of that Act::--
73A.
(1) Where the Minister is of the opinion that the activities designed and carried out for the purposes of providing facilities and services to tourists in any area, not being an area comprising a national holiday resort) requires to be regulated and controlled, he may, by Order published in the Gazette, declare such area to be a tourist development area.
(2) Every Order made under subsection (1) shall define the area by setting out the metes and bounds of the lands or each of the lands comprised in the area.
(3) If the area or any part of the area which is to be declared a tourist development area by an Order made by the Minister under subsection (1) is within the administrative limits of any local authority, no such Order shall be made by the Minister except with the concurrence of the Minister in charge of the subject of Local Government.
73B. The functions of the Board in relation to each tourist development area shall be-
(a) to promote, plan and encourage the development of tourist facilities and services within such development area;
(b) regulate, control, maintain and operate tourist facilities and services within such development area.
73c. With effect from such date as may be appointed by the Minister by Order published in the Gazette hereinafter referred to as the" relevant date"), no person shall, without the approval of the Board, given with the concurrence of the Urban Development Authority established by Law No. 41 of 1978 and the local authority within the limits of which such tourist development area is situate-
(a) construct or erect any building or structure; or
(b) re-erect, alter or convert any existing building or structure; or
(c) set up and or carryon any establishment or business,
