FOOD SAFETY ACT (CAP. 449)
The Addition of Vitamins and Minerals and of certain other
Substances to Foods Regulations, 2008
IN exercise of the powers conferred by article 10 of the Food Safety Act, the Minister of Health, the Elderly and Community Care has made the following regulations>-

Citation and scope.

Designation of the Competent Authority.

Notification to the Competent Authority.

1. (1) The title of these regulations is the Addition of Vitamins and Minerals and of certain other Substances to Foods Regulations,
2008.
(2) These regulations contain the provisions necessary for the implementation of Regulation (EC) No 1925#2006 of the European Parliament and of the Council of 20 December, 2006 on the addition of vitamins and minerals and of certain other substances to foods.
2. The Directorate responsible for foodstuffs within the Malta Standards Authority is hereby designated as the competent authority referred to in Regulation (EC) No 1925#2006, hereinafter referred to as the Competent Authority.
3. (1) To facilitate efficient monitoring, when a food to which vitamins and minerals have been added, and a food containing substances listed in Annex III, Parts B and C, of Regulation (EC) No 1925#2006, is placed on the market for the first time, the manufacturer or importer shall notify the Competent Authority by forwarding a model of the label used for the product.
(2) In the case of foods placed on the market prior to the entry into force of these regulations, the notification prescribed by sub- regulation (1) hereof shall take place by not later than 31st December
2008. Foodstuffs which have not been notified by that date shall be removed from the market at the expense of the manufacturer or importer.
