PASSPORTS ORDINANCE (CAP. 61)Passport (Amendment) Regulations, 2009

IN exercise of the powers conferred by article 9 of the Passports Ordinance, the Minister for Infrastructure, Transport and Communication, with the concurrence of the Minister of Finance, the Economy and Investment, has made the following regulations:-

1. (1) The title of these regulations is the Passport (Amendment) Regulations, 2009 and they shall be read and construed as one with the Passport Regulations, 1993, herinafter referred to as “the principal regulations”.

(2) These regulations shall come into force on the 27
March 2009.

2. Sub-regulation (1) of regulation 2 of the principal regulations shall be amended as following:

(a) in paragraph (b) thereof for the words “citizens,”
there shall be substituted the words “citizens; or”; and
(b) immediately after paragraph (b) thereof, there shall be added the following new paragraph:
“(c) other persons who are not persons of Maltese nationality and are in Malta without a valid passport in terms of the provisions of regulation 2A of these regulations.”.

3. Immediately after regulation 2 of the principal regulations, there shall be added the following new regulation:

the principal regulations.

“Travel document for alien persons, etc.

2A. (1) In the case of persons mentioned in paragraph (c) of sub-regulation (1) of regulation 2, a travel document or passport issued under these regulations shall:
(a) be of a different colour and have different wording which distinguishes it from passports issued to persons mentioned in paragraphs (a) and (b) of sub-regulation (1) of regulation 2;

(b) contain a clear indication showing that the document does not purport to give any right of residence in Malta, or any social or work benefit in Malta, unless there is explicit authorization to this effect on the document itself;
(c) be indicated as an “Alien Travel Document” or as an “Alien’s Passport”, as the case may be;
(d) beissuedaccordingtostandardsapplicable for the issuing of passports in the European Union and be valid for travel to all countries;
(e) contain an indication that this document or passport was only issued so that the person will be in possession of a travel document and that without any prejudice, it does not affect or change the nationality of its holder in any way whatsoever;
(f) be valid for a period of one year from the date of issue.
(2) Insofar as the “Alien Travel Document” or an “Alien’s Passport” are concerned, the provisions of regulations 4, 9 and 10 of these regulations shall not apply.”.
