PLANT QUARANTINE ACT (CAP. 433)Forest Reproductive Material (Amendment) Regulations, 2011

IN exercise of the powers conferred by article 32 of the Plant Quarantine Act, the Minister for Resources and the Rural Affairs, has made the following regulations:-

1. The title of these regulations is the Forest Reproductive Material (Amendment) Regulations, 2011 and they shall be read and construed as one with the Forest Reproductive Material Regulations, 2004, hereinafter referred to as “the principal regulations”.2. Regulation 3 of the principal regulations shall be amended as follows:

(a) the definition “the Department” shall be deleted;
(b) immediately after the definition “the Directorate”,
there shall be added the following new definition:
“ “ t h e D i r e c t o r a t e ” m e a n s t h e D i r e c t o r a t e
responsible for plant health;” and
(c) for the words “the Department” wherever they occur in the principal regulations there shall be substituted the words “the Directorate”.

3. For regulation 21 of the principal regulations, there shall be substituted the following:

21. (1) In order to prevent trade patterns from being disrupted, the Directorate shall determine whether forest reproductive material produced in third countries referred to in Commission Decision 2008/989/EC authorising Member States, in accordance with Council Directive 1999/105/EC, to take decisions on the equivalence of the guarantees afforded

by forest reproductive material to be imported from certain third countries, affords the same guarantees as regards the approval of its basic material and the measures taken for its production, with a view to marketing as in the case of forest reproductive material produced within the European Union and which complies with the provisions of these regulations.
(2) The provisions contained in Council Decision
2008/971/EC on the equivalence of forest reproductive material produced in third countries, shall apply in case of third countries referred to in such Decision.”.
