PRODUCT SAFETY ACT (ACT NO. V OF 2001)Indication by Labelling and Standard Product Information of the Consumption of Energy and other Resources by Household Appliances (Amendment) Regulations, 2003

IN exercise of the powers conferred by articles 38 to 40 of the Product Safety Act, 2001, the Minister for Economic Services, on the advice of the Malta Standards Authority, has made the following regulations:-

1. (1) The title of these regulations is the Indication by Labelling and Standard Product Information of the Consumption of Energy and other Resources by Household Appliances (Amendment) Regulations,

2003, and they shall be read and construed as one with the Indication by Labelling and Standard Product Information of the Consumption of Energy and other Resources by Household Appliances Regulations,
2002, hereinafter referred to as “the principal regulations”.

2003:
(2) These regulations shall come into force on 1st January,
Provided that the placing on the market, the marketing and, or the display of products and the distribution of communications referred to in regulations 5.9 and 5.10 of the principal regulations shall be permitted, until 30th June, 2003.

2. (a) Immediately after regulation 5.2.12 of the principal regulations, there shall be inserted the following new paragraphs:

“5.2.13. The label referred to in regulation 5.2 of these regulations, with respect to household electric ovens, shall be as specified in section 4 of Schedule VII to these regulations.

5.2.13.1. The label shall be placed on the door of the appliance, in such a way as to be clearly visible and not obscured. For multi-cavity ovens, each cavity shall have its own label, except a cavity which does not fall within the scope of the harmonised standards referred to in section 2 of Schedule VII to these regulations.
5.2.14. The content and format of the fiche referred to in regulation 5.2 of these regulations, with respect to household electric ovens, shall be as specified in section 5 of Schedule VII to these regulations.
5.2.14.1. The appropriate terms to be used on the label and the fiche as referred to in regulation 5.2 of these regulations shall be selected from the table set out in section
8 of Schedule VII to these regulations.
5.2.15. The label referred to in regulation 5.2 of these regulations, with respect to household air-conditioners, shall be as specified in section 4 of Schedule VIII to these regulations.
5.2.15.1. The label shall be placed on the outside of the front or top of the appliance in such a way as to be clearly visible and not obscured.
5.2.16. The content and format of the fiche referred to in regulations 5.2 of these regulations, shall be as specified in section 2 of Schedule VIII to these regulations.”.
(b) Immediately after regulation 5.8.6 of the principal regulations, there shall be inserted the following new paragraphs:
“5.9. With respect to household electric ovens, where the appliances are offered for sale, hire, or hire purchase by way of a printed or written communication or by other means whereby the potential customer cannot be expected to see the appliance displayed, such as a written offer, a mail order catalogue, advertisements on the Internet or other electronic media, that communication shall include all the information specified in section 6 of Schedule VII to these regulations.
5.9.1. This requirement shall also apply in respect of offers for built-in ovens for integrated kitchens.
5.10. With respect to household air-conditioners, where the appliances are offered for sale, hire or hire purchase by means of a printed or written communication, or by other
means which imply that the potential customer cannot be expected to see the appliance displayed, such as a written offer, a mail order catalogue, advertisements on the Internet or on other electronic media, that communication shall include all the information specified in section 6 of Schedule VIII to these regulations.”

3. Immediately after regulation 6.12 of the principal regulations, there shall be inserted the following new paragraphs:

“6.13. The energy efficiency class of each cavity of an oven, with respect to household electric ovens, shall be determined in accordance with section 7 of Schedule VII to these regulations.
6.14. The energy efficiency class of an appliance, with respect to household air-conditioners, shall be determined in accordance with section 7 of Schedule VIII to these regulations.”

4. For the table titled ‘LIST OF SCHEDULES’ of the principal regulations, there shall be substituted by the following:

5. (a) For Schedule VII of the principal regulations, there shall be substituted the following:“Schedule VIIBased on Council Directive 2002/40/EC, implementingCouncil Directive 92/75/EEC1. Scope

Amends regulation

6 of the principal regulations.

Amends the table titled ‘LIST OF SCHEDULES’ of the principal regulations.

Substitutes Schedule VII of the principal regulations.

This Schedule shall apply to electric mains operated household electric ovens including ovens being part of larger appliances.
It shall not apply to the following ovens:
(a) ovens that can also use other energy sources;
(b) ovens which do not fall within the scope of the harmonised standards referred to in section 2;
(c) portable ovens, being appliances other than fixed appliances, having a mass of less than 18 kg, provided they are not designed for built-in installations.
The energy consumption of the steam functions, other than the hot steam function, are not covered by this Schedule.

2. General requirements

The information required by this Schedule shall be obtained by means of measurements made in accordance with harmonised standards adopted by the European Committee for Electrotechnical Standardisation (Cenelec) under mandate from the Commission in accordance with Directive 98/34/EC, the reference numbers of which have been published in the Official Journal of the European Communities and for which Member States have published the reference numbers of the national standards transposing those harmonised standards.
The provisions of sections 4, 5 and 6 of this Schedule requiring the giving of information relating to noise shall apply only where that information is required by Member States under Article 3 of Directive 86/594/EEC as implemented by L.N. 91 of 2002

: Airborne Noise Emitted by Household Appliances Regulations,
2002. This information shall be measured in accordance with those
Regulations.

3. Technical documentation

The technical documentation referred to in regulation 5.5 of these regulations shall include:
- the name and address of the supplier;
- a general description of the model, sufficient for it to be unequivocally and easily identified;
- information, including drawings as relevant, on the main design features of the model and in particular items which appreciably affect its energy consumption;
- reports of relevant measurement tests carried out under the test procedures of the harmonised standards referred to in section
2 of this Schedule;
- operating instructions, if any.

4. THE LABEL Label design

1. The label shall be the relevant language version chosen from the following illustrations:
