RADIOCOMMUNICATIONS ACT (CAP. 49)Radiocommunications Apparatus Exemption Order, 2010

IN exercise of the powers conferred by article 3 of the Radiocommunications Act, the Minister for infrastructure, Transport and Communications, after consultation with the Malta Communications Authority has made the following Order:-

. Exemption.

1. The title of this Order is the Radiocommunications

Apparatus Exemption Order, 2010.

2. In this Order unless the context otherwise requires:

“land mobile-satellite service” means a mobile-satellite service in which the mobile-satellite terminals are located on land;
“land mobile-satellite terminals” means a terminal in the land mobile-satellite service capable of surface movement with the geographical limits of a country or continent;
“the Minister” means the Minister responsible for communications;
“mobile-satellite service” means a radiocommunications service between mobile-satellite terminals and one or more space stations or between space stations used by this service, or between mobile-satellite terminals by means of one or more space stations;
“mobile-satellite terminals” means a terminal in the mobile-satellite service intended to be used while in motion or during halts at unspecified points;
“R&TTE Regulations” means the Radio Equipment and Te l e c o m m u n i c a t i o n s Te r m i n a l E q u i p m e n t a n d t h e M u t u a l Recognition of their Conformity Regulations, 2002.

3. T h e M i n i s t e r, a f t e r c o n s u l t a t i o n w i t h t h e M a l t a Communications Authority, hereby orders that the following radiocommunications apparata shall be exempted from the requirements of article 3 of the Radiocommunications Act:VERŻJONI ELETTRONIKA

(a) Mobile-satellite terminals which:
(i) operate under the control of an authorised satellite system;
(ii) comply with the provisions of the R&TTE Regulations; and
(iii) operate on the frequencies listed in table number 1.
