SUPPLIES AND SERVICES ACT (CAP. 117)Agricultural Marketing Centres (Amendment) Regulations,2011

IN exercise of the powers conferred by article 3 of the Supplies and Services Act the Minister of Finance, the Economy and Investment, has made the following regulations:-

1. T h e t i t l e o f t h e s e r e g u l a t i o n s i s t h e A g r i c u l t u r a l Marketing Centres (Amendment) Regulations, 2011 and they shall be read and construed as one with the Agricultural Marketing Centres Regulations 1975, hereinafter referred to as “the principal regulations”.2. In regulation 2 of the principal regulations for the definition “Director” there shall be substituted the following:

“the Director” means the Director responsible for wholesale markets;” .

3. In subregulation (1) of regulation 4 of the principal regulations the words “, not being a Sunday, a public holiday or Good Friday, ” shall be deleted.4. Sub-regulation (1) of regulation 16 of the principal regulations shall be amended as follows:

(a) for paragraph (a) thereof there shall be substituted the following:
“(a) on a first conviction, to a fine (multa) of not less than five hundred euro (500) but not exceeding one thousand two hundred euro (1,200);”;
(b) for paragraph (b) thereof there shall be substituted the following:
“(b) on a second or subsequent conviction, to a fine (multa) of not less than one thousand two hundred euro (1,200) but not exceeding two thousand and three hundred and twenty-nine euro and thirty-seven cents

(2,329.37), and to the suspension of any permit, pass or licence, for a period of not less than one month but not exceeding six months.” ; and
(c) paragraph (c) thereof shall be deleted.

Adds new regulation

17 to the principal regulations.

4. I m m e d i a t e l y a f t e r r e g u l a t i o n 1 6 o f t h e p r i n c i p a l regulations there shall be added the following new regulation:

“Suspension or revocation of any licence

17. Any licence, permit or pass granted for the purpose of these regulations may be suspended

permit or pass. or revoked at any time by the authority or person

empowered to grant it.” .
