VETERINARY SERVICES ACT, 2001 (ACT NO. XXIII OF 2001)Zootechnical and Pedigree Requirements for the Marketing of Pure-BredAnimals, 2003

IN exercise of the powers conferred by article 34 of the Veterinary Services Act,
2001, the Minister for Rural Affairs and the Environment has made the following regulations:-

Title and scope1. (1) The title of these regulations is the Zootechnical and Pedigree

Requirements for the Marketing of Pure-Bred Animals.
(2) The scope of these regulations is to implement the provisions found under European Union Council Directive 91/174/EEC has made the following regulations laying down zootechnical and pedigree requirements for the marketing of pure-bred animals.

Definitions2. For the purposes of these regulations–

“Pure-bred animal” shall mean any animal for breeding, the trade in which has not yet been the subject of more specific zootechnical legislation and which is entered or registered in a register or pedigree record kept by a recognised breeders' organisation or association;
“Trading Partner” in the meaning of article 2 of the Veterinary Services Act shall mean –
(a) Member State of the European Community; (b) Third country to the European Community.

Marketing of pure-bred animals3. In the territory of Malta -

(a) The marketing of pure-bred animals and of the semen, ova and embryos thereof is not prohibited, restricted or impeded on zootechnical or pedigree grounds;
(b) In order to ensure that the requirement provided for in the sub-regulation (1) is satisfied, the criteria for approval and recognition of breeders' organisations or associations, the criteria for entry or registration in pedigree records or registers, the criteria for approval for reproduction of pure-bred animals and for the use of their semen, ova and embryos, and the certificate to be required for their marketing should be established in a non-discriminatory manner, with due regard for the principles laid down by the organisation or association which maintains the register or pedigree record of the breed in question.

Veterinary Services Act, article 37(f).4. The detailed rules for the application of these regulations shall be adopted in accordance with the procedure laid down in article 34(f) of the Veterinary Services Act.
