IN exercise of the powers conferred by article 34(d) of the Veterinary Services Act,
2001, the Minister for Rural Affairs and the Environment has made the following regulations:-
(2) The scope of these regulations is to implement the rules found under European Union Commission Decision 92/354/EEC laying down certain rules to ensure co-ordination between organisations and associations which maintain or establish stud-books for registered equidae. This Decision finds its legal basis under European Union Council Directive 90/427/EEC, article 4(2)(e).
Close collaboration with the organisation and associations2. The organisation or association which maintains the stud-book of the origin of the breed must ensure close collaboration with the organisation and associations which maintain stud-books or sections of a stud-book of the same breed, particularly with a view to preventing any dispute.Non-compliance with rules laid down in zootechnical legislation3. (1) Where the competent authority considers that an approved or recognised organisation or association in a Member State is not complying with the rules laid down in the relevant zootechnical legislation, and particularly with the principles laid down by the organisation or association which maintains the stud- book of the origin of the breed, it shall contact the competent authority of the Member State concerned forthwith.(2) If the competent authorities considers these measures likely to be insufficient, it shall explore with the authority of
the Member State ways of remedying the situation, if necessary by visiting that Member State.
(3) The competent authorities shall inform the European Commission of the solutions decided upon.
(2) The competent authority shall take all the necessary measures and inform the competent authority of the Member State of the type
of checks carried out, the decisions taken and the reasons for those decisions.
(3) If the competent authorities of the Member State considers these measures likely to be insufficient, it may explore with the authority
of the territory of Malta ways of remedying the situation, if necessary by visiting the territory of Malta.
(4) The competent authorities of the territory of Malta shall inform the
European Commission of the solutions decided upon.
