MINISTERIAL FUNCTIONS ACT 1969

An Act to make provisions for declaring the functions and the transfer of functions of Ministers, for declaring the styles and titles of Ministers, and for incidental and connected purposes. [Throughout Malaysia--27 February 1969]

BE IT ENACTED by the Seri Paduka Baginda Yang di-Pertuan Agong with the advice and consent of the Dewan Negara and Dewan Rakyat in Parliament assembled, and by the authority of the same, as follows:

Short title

1. This Act may be cited as the Ministerial Functions Act 1969. Functions, styles and titles of Ministers

2. (1) The Yang di-Pertuan Agong may by order notify in the Gazette--

(a) that a Minister has been conferred with any functions or has been charged with any responsibility in respect of a particular department or subject or that any transfer, to any other Minister, of any of the functions or responsibility referred to has been made;

(b) that any style or title has been assigned to any Minister (except the Prime Minister) or that any change in any style and title referred to has been made.

(2) An order made by the Yang di-Pertuan Agong under this section--

(a) may provide for the transfer of any property, rights or liabilities held, enjoyed or incurred by any Minister in connection with any functions conferred or

transferred; and

(b) may contain such other provisions as may be

necessary or expedient for the purpose of giving effect to the order.

Effect of transfer of functions and change of style and title

3. Where an order is made by the Yang di-Pertuan Agong under section 2 anything commenced, or done before the order came into force by or under the authority of the Minister whose functions and responsibility have been transferred or whose style or title is changed may be continued or completed by that Minister. Reference in written laws

4. Any reference in any written law or in any instrument, contract or legal proceedings to any Minister as such by the style or title of his office shall unless the context otherwise requires, be construed as a reference to the Minister for the time being conferred with the functions or charged with the responsibility or to the Minister for the time being assigned with such style or title. Repeal and saving

5. The Ministers of the Federal Government (Transfer of Functions) Ordinance 1951 [No. 15 of 1951], is hereby repealed: Provided that orders made under that Ordinance or any other written law relating to the transfer of functions of a Minister or public officer which were in force immediately before the commencement of this Act shall be deemed to have been made under this Act and shall remain in force, and may be amended or revoked, accordingly.
