(UNDER RULE 65 bis)

THE TRIAL CHAMBER (“Trial Chamber”) of the Special Court for Sierra Leone (“Special Court”) composed of Judge Bankole Thompson, Presiding Judge, Judge Benjamin Mutanga Itoe and Judge Pierre Boutet;


RECALLING the Trial Chamber’s decision of 27 January 2004, in which it ordered that the accused Sam Hinga Norman, Moinana Fofana and Allieu Kondewa (singularly or collectively, “Accused”) be tried jointly;


CONSIDERING THAT the rights of the Accused will be advanced by convening a Status Conference to organize exchanges between the Parties so as to ensure expeditious trial proceedings, with the aim to set a trial date as soon as practicable;


PURSUANT TO Rule 54 and Rule 65 bis of the Rules of Procedure and Evidence of the Special Court (“Rules”);


HEREBY ORDERS that a Status Conference shall be held on Thursday, 4 March 2004 at 10:00am;


And FURTHER ORDERS that the agenda for the Status Conference shall include, inter alia:


  1. The opportunity for each Accused to raise any issues in relation to his case, as well as issues related to his physical and mental condition;
  2. A review of the status of pending motions, if any, with the Parties;
  3. An update from the Parties on compliance with disclosure obligations under Rule 66, Rule 67 and Rule 68 of the Rules, and any outstanding issues related thereto;
  4. A preliminary indication from the Office of the Prosecutor (“Prosecution”) on the number of witnesses it intends to call viva voce and the number of witnesses for whom it intends to tender testimony pursuant to Rule 92 bis of the Rules;
  5. A preliminary indication from the Prosecution of the number and nature of exhibits it intends to tender at trial;
  6. An indication from the Prosecution of the number of expert statements or reports it intends to tender at trial pursuant to Rule 94 bis of the Rules, and the nature of such expert statements;
  7. An indication from the Prosecution of any changed circumstances in relation to witnesses for whom protective measures have been granted such that protective measures shall be rescinded or augmented;
  8. An indication from the Parties of points of agreement or disagreement on matters of law and fact; and
  9. The estimated length of time required for the presentation of the Prosecution’s case.
