TRIAL CHAMBER II

ORDER ON EXPEDITED FILING AND SCHEDULING ORDER

I, JUDGE TERESA DOHERTY, Presiding Judge of Trial Chamber II (“Trial Chamber”) of the Special Court for Sierra Leone (“Special Court”), designated from among the members of Trial Chamber II pursuant to Rule 73(A) of the Rules of Procedure and Evidence of the Special Court (“the Rules”);

BEING SEIZED OF the Defence Motion for Dismissal of Counts 15 – 18 of the Indictment Due to an Alibi Defence and Lack of Prima Facie Case on behalf of the Accused Santigie Kanu (“Defence Motion”), filed on 21 January 2005 and noting the submissions of the Parties thereto;

NOTING the Prosecution Application to further Amend the Amended Consolidated Indictments by Withdrawing Counts 15 – 18 (“Prosecution’s Motion”), filed on 7 February 2005 pursuant to Rule 50(A) and 73 (A) of the Rules of Procedure and Evidence of the Special Court for Sierra Leone (“the Rules”);

NOTING the Order of the Trial Chamber on the Commencement of the Trial on 7 March 2005:

CONSIDERING that an expeditious consideration of the Motion necessitates the imposition of an expedited timetable of any remaining written submissions;

PURSUANT to Rule 7(C) of the Rules;

HEREBY ORDER that:

1. Any response of the Defence to the Prosecution’s Motion shall be filed by Friday, 11 February 2005;
2. Any Prosecution Reply thereto shall be filed by Tuesday, 15 February 2005;

PURSUANT to Rule 54 of the Rules;

FURTHER ORDER that a hearing for the Defence Motion shall be held on 16 February 2005, at 2:00 p.m. in Courtroom 2.
